Nigeria- SNO National Carrier Licence

This document is an example of a licence granted by the Nigerian Communications Commission (“NCC”) for the provision and operation of a Public Switched Telecommunications Network and Carrier services in Nigeria.

The licence is a two page document, which outlines:

·   the powers under which the NCC has the authority to grant the licence;
·   the party to whom the licence is being granted;
·   the term of the licence;
·   renewal rights; and
·   the service rights granted.

The licence conditions are contained in schedules to the licence. 

Included in the schedules are definitions, general conditions, specific conditions on technical and service issues and approvals from government authorities.

The general conditions in Schedule 1 relate to, among other things, the following issues:

·  the universal provision of telecommunications services in rural areas;
·  maintenance services;
·  international services;
·  public emergency call services;
·  public payphone services;
·  resale;
·   the prohibition of undue preference and undue discrimination;
·    the prohibition of cross subsidies;
·    licence transfer;
·    licence amendment and revocation;
·     interconnection arrangements;
·      payment of fees; and
·      value added service providers.

The specific conditions on technical and service issues in Schedule 2 relate to, among other things, the following issues:

·  the scope of operation;
·   technical standards and specifications;
·   access and inspection;
·   authorizations, permits and licences
·    network rollout;
·    frequency assignments;
·    performance specifications; equipment approval;
·   licence limitations;
·   numbering arrangements; and
·   the provision of special features and services.

 

The approvals from government authorities in Schedule 3 relate to the following:

· overhead lines;
·  conservation areas;
·   national parks;
·   highways;
·   electricity bodies;
·   emergency works; and
·   public events and construction sites.
